Judge reduces judgment against Austin police officer from $1 million to $60,000

A federal judge has ordered that a judgment in an excessive force lawsuit against an Austin police officer in March be reduced from $1 million to $60,000.

Federal judge Sam Sparks (R) wrote on Thursday that plaintiff Carlos Chacon did not show enough evidence of pain and mental anguish in his lawsuit against Austin police officer Russell Rose. On March 6, a federal jury found that Rose was fully liable for injuries Chacon suffered during a 2011 arrest in which police shocked him with a stun gun and punched him in the face.

The judge gave Chacon a choice, either accept the $60,000 or go to trial over the amount of damages he believes he should be awarded.

When reached by phone Friday, Chacon’s attorney Erica Grigg said that they had not made a decision on how to proceed.
