Police: Intoxicated parents let 13-year-old daughter drive family home

AUSTIN -- After drinking too much at a club, two parents let their 13-year-old daughter drive them and their 7-year-old daughter home along Interstate 35, according to a arrest warrant affidavit.

Alvaro Benitez, 48, and Araceli Mata-Ortiz, 41, were charged with child endangerment after police were called Sunday at 10:50 p.m. about a car driving erratically and so dangerously slow that other cars almost struck it, the affidavit says. Police found the car driving 25 miles below the 70 mile-per-hour speed limit. The car was “weaving back and forth, and drove on the improved shoulder of the roadway,” according to the affidavit.

When stopped, the 13-year-old driver told police that she had been with her parents at Club Vongos, a bar on 6700 Middle Fiskville Rd., and “observed her mother and father were too intoxicated to drive” after they left.

“She suggested she should drive home because she felt it would be safer,” the affidavit says.
