Attorney General Ken Paxton moved Thursday to appeal a trial judges recent decision to uphold felony charges that he broke state securities laws during private business deals in 2011 and 2012.
State District Judge George Gallagher rejected Paxtons multiple pretrial requests to dismiss the charges in a series of succinct Dec. 11 rulings that offered no legal explanation for the decisions but put Paxton on course for trial as early as late summer.
On Thursday, Paxtons lawyers notified Gallagher that they intend to appeal his rulings to the 5th Court of Appeals in Dallas.
Our pleadings are solid and well-grounded in law and fact, defense lawyer Bill Mateja said in a statement. We are optimistic that we will prevail in the higher court.

(12,157 posts)and Joe Sixpack just rots in jail. Our "justice" system is as fair in the same way our medical care is the "best" in the world. It just depends on who you are.

(12,157 posts)Those with dinero can obfuscate and delay; making motions for this and than. Those without are facing a prosecutor with the full force of the state behind him/her including the P.D. and the forensic lab while this person gets a defense attorney without resources to mount a real defense even if he/she were so inclined to really fight for their client.
I have been waiting for someone to tell me that if they had the choice when facing trial for a criminal offense that they would rather have a court appointed attorney represent them rather than O.J.'s "dream team." So in our hearts we know that it is not fair but once again the majority sides with the moneyed against the impoverished. "If they just pull themselves up by their bootstraps they wouldn't be in this predicament."
