Updated: It is reported that at Jason Kessler's perjury trial he was abruptly discharged.

There was an issue with the commonwealth's case.

A local attorney has posted on Facebook that the case cannot be brought again.

The perjury charge against Jason Kessler was discharged Tuesday in Albemarle Circuit Court after a judge found that the prosecution did not show where the alleged crime took place.

The charge against Kessler cannot be brought again, due to double jeopardy.

The case stemmed from an incident on the morning of Jan. 22, 2017, when Kessler said a man assaulted him on the Downtown Mall. City prosecutors eventually dismissed the charge against the man — identified as James Taylor — after viewing surveillance video that reportedly contradicts Kessler’s statements.
