Judge rules he can't review why Brian Brimager charged in San Diego and not in Panama

SAN DIEGO The former Marine accused of killing and dismembering his girlfriend on a Panamanian island tried to get his case dropped by challenging the ability of the U.S. to charge him with a crime that allegedly happened in another country.
The law foreign murder of a U.S. national is rarely invoked and its use must be approved at the highest levels of the U.S. Department of Justice.
The effort by Brian Brimagers defense lawyers was in the end unsuccessful last week, but the debate provided a glimpse into how the law is used.
Brimager is accused of killing his then-girlfriend, Yvonne Baldelli, in 2011 on Isla Carenero, then embarking on an elaborate cover-up scheme that included disposing of her remains and sending fake emails to her family. He moved to the North County shortly after and married the mother of his young child.
