Ex-bank CFO waits in limbo over threat of criminal suit

Cynthia Sabol, former chief financial officer at Bank of the Commonwealth, has been waiting 13 months for federal authorities to indict her. Or not.

Through her attorney, she has tried to shield from public view court documents that show she has been a target of the government's ongoing criminal investigation into the bank's collapse. This week, a judge ordered those documents unsealed.

The documents were revealed in a separate civil lawsuit filed against her by the U.S. Securities and Exchange Commission a year ago.

"Ms. Sabol remains in jeopardy of broadly drawn criminal charges," her attorney wrote to the judge in an effort to put on hold any action in the civil suit, arguing that proceeding with the civil action would be unfair and that making the documents public would prejudice the case against her.
