Ordinance outlaws fake guns where real ones are banned

The Carrollton City Council has amended the city’s firearms ordinance to make it clear that the displaying of fake or facsimile firearms are illegal in any public place.

At a regular meeting on Aug. 20, the council voted 6-0 to add wording to that was already in place that stated, “It shall be unlawful for any person to display or brandish a facsimile firearm in a public place.”

The amendment adds: “or any place a firearm is prohibited by state law within the corporate limits of the city.”

The council also passed an amendment stating, “It shall be unlawful for any person to possess a facsimile firearm in any place a firearm is prohibited by state law within the corporate limits of the city.”

New law makes threats with fake guns a felony

20-year-old man charged with felony after threatening incident
Published 1:51 PM HST Aug 23, 2013



HONOLULU —A man accused of threatening a woman with a fake gun will be the first to be tried under a new law that makes that offense a felony.

20-year old Timothy Maioho was indicted on a charge of terroristic threatening for the Aug. 14 incident.

Court documents say the woman spotted Maioho holding what she thought was a gun in the parking lot near the Jack in the Box at South King and Kalakaua.

If you make someone BELIEVE that you have a gun, "whether or not you actually have one" even a finger inside your coat, or saying you "have a gun"... You will be prosecuted as if you did, it will not matter that you did not.

Been like this for DECADES here.

But unfortunately Carrollton city council is not very smart to pass a clear and concise law like Virginia did, I wonder how they will deal with children playing finger "pow pow" around town now, since they now committing felonies.

Especially in light of the heavy handed suspension of the boys playing with airsoft guns in their own yards.
