The Consent Decree wiped out the claim for monetary damages for the activities complained of in the original complaint. But it preserves the parties rights to seek relief at law or equity if the RNC engages in the activities that the Consent Decree binds it not to engage in. I suspect the RNC and DNC disagree as to whether the DNC (or someone else) can bring a new suit for damages based not on the actions the were the underpinning of the original complaint, but new activities. As best I can tell, however, whenever the DNC has complained about violations of the Consent Decree, it has only sought injunctive relief and/or an extension of the Decree, not a new claim for monetary damages
