Ackerman is certainly correct that the Speech or Debate Clause immunizes members of Congress from prosecution for disclosing classified information on the floor or in committee hearings. As he also recognizes, however, members are not protected against congressional discipline, up to and including expulsion, for revealing classified information without permission.

If this is correct he couldn't be prosecuted but he could still face consequences.

First, it would require a 2/3 vote to expel a Senator. The Republicans would get nowhere near that. Plus the political costs to them for trying to expel someone who revealed that Russia interfered with our election are probably something they wouldn't want to incur.

Obama doesn't seem disposed to take any action regarding election interference. He should have reined Comey in back in July, but nope.

They can do so without legal consequences if they do it properly. Going to Obama first may simply have been a matter of trying to do it the more "acceptable" way first before using the protection of the Senate floor to release the information.
