2016 Postmortem
Related: About this forumLegal experts see no criminal trouble for Clinton thus far .......
Experts in government secrecy law see almost no possibility of criminal action against Hillary Clinton or her top aides in connection with now-classified information sent over unsecure email while she was secretary of state, based on the public evidence thus far.
By contrast, there is no evidence of emails stored in Hillary Clinton's private server bearing classified markings. State Department officials say they don't believe that emails she sent or received included material classified at the time. And even if other government officials dispute that assertion, it is extremely difficult to prove anyone knowingly mishandled secrets.
"How can you be on notice if there are no markings?" said Leslie McAdoo, a lawyer who frequently handles security-clearance cases.
Clinton's critics have focused on the unusual, home-brew email server Clinton used while in office and suggested that she should have known that secrets were improperly coursing through an unsecure system, leaving them easily hackable for foreign intelligence agencies. But to prove a crime, the government would have to demonstrate that Clinton or aides knew they were mishandling the information not that she should have known.
A case would be possible if material emerges that is so sensitive Clinton must have known it was highly classified, whether marked or not, McAdoo said. But no such email has surfaced. And among the thousands of documents made public, nothing appears near the magnitude of the Top Secret material Petraeus and Deutch mishandled.

(6,409 posts)The "experts" who are weighing in on this cannot agree with each other about which agency was responsible, what was the correct procedure, whether or not Clinton or anybody who worked for her is responsible for handling the messages as classified, what the level of classification should be, and so on, and so forth. From my experience in the military, this surprises me not at all.

(22,308 posts)for government business, she admitted that herself.
We know that she should have turned over the server. After 5 months of fighting it she finally had to do it.
We know that she evades questions about having the server wiped.
We know that the "didn't want to carry two phones" excuse took 8 days to dream up and was pure bull shit.
We know that a judge ordered emails to be released every 30 days, so this is going to drag on for months.
We know that the campaign is unable to move past this story.
We know that there are other things in her past worse than this that will also be used to attack her.
We also know that she just rolled out a policy to expand corn based ethanol even though corn based ethanol is a spectacular failure.
We know that she refused to state her position on the Keystone XL pipeline with a statement that she will answer that after she becomes President.
We know that she has taken multiple positions on TPP and still won't take a clear stand on it.
In My Opinion, we should know enough to not allow her to be our nominee.

(4,229 posts)Every time a batch of emails comes out there's nothing new about Benghazi (the reason for wanting to look at them) there's really no evidence of deliberately sending classified info.
It's just almost a National Enquirer type thing were they report on what she said on who. Great for the GOP to make her look less presidential but nothing really damninng.
I'm for Sanders but I think this whole email thing, I mean the way they are going public and the news organizations are writing about them is really tabloid like.
