Labor charge alleges Sanders campaign management retaliated against union activities

BY MAX GREENWOOD - 07/25/19 04:01 PM EDT

An anonymous unfair labor practice charge against Sen. Bernie Sanders’s (I-Vt.) 2020 presidential campaign alleges that at least three staffers were fired from the team for their involvement in organizing and labor activities, according to a redacted copy of the charge obtained by Bloomberg Law.

The charge, which was filed with the National Labor Relations Board (NLRB) by a former campaign employee on July 22, also alleges that the campaign violated a collective bargaining agreement with unionized workers by making staffers work additional days and failing to provide commensurate days off.

When the individual asked the campaign to abide by the terms of the collective bargaining agreement, management retaliated, the charge alleges.

“[Campaign management] retaliated against me when I organized the bargaining unit and sent an email requesting compliance with the [collective bargaining agreement],” the person wrote in the charge.

If the moderators at the debate don't call him out, the other candidates must. He is constantly having sketchy things happen in his campaign, yet each time he professes ignorance of the problem (like with the Union bargaining issue recently and the 2016 female staffer issue), or he remains silent or back up staff that attacks other democrats.

The initial inquiry will tell a lot. If the NRLB takes it up it will tell us a lot very quickly. First they do a very basic inquiry. If they smell smoke they ramp up an investigation. If you see this turn into an investigation it's big.

14. Washington Post-Sanders campaign union faces accusation, federal filing shows
Sat Jul 27, 2019, 11:52 AM
Jul 2019

The document filed earlier this week with NLRB against the Sanders campaign alleged that the campaign discharged, disciplined or retaliated against employees for reasons including joining or supporting a labor organization and engaging in protected labor-related activities. It also alleged that the campaign interrogated employees about union activities.

At the end of the filing, the charging party included additional information in support of the claims, including accusations that the campaign “failed to notify us upon hire” that there was a collective bargaining agreement and that it violated the agreement by requiring additional workdays.

That earlier complaint hinted at a forthcoming action against the union. “The Union did nothing” to address the issues with the campaign, it says, adding, “I will be filing a DFR against them.” A DFR often refers to a “duty of fair representation,” which is what was filed Thursday against the union.

The charge against the Sanders campaign also alleges, “At hiring, employer promised some employees housing, and not others; some were promised expenses, and others were not. The [collective bargaining agreement] requires relocation expenses be paid. Employer retaliated against me when I organized the bargaining unit and sent an email requesting compliance with the CBA.”
