Just name them as "acting-Secretary" and move on.

Oh and there is a corollary to the first "new" amendment:

- Sedition is not a crime if you are POTUS and leaving office otherwise...also known now and forevermore as the "January exemption", where the President becomes an infallible monarch from the Wednesday after the election to 11:59 AM on January 20th following the election of the President.
