I believe the hideously misnamed USA PATRIOT Act has made it so that the intelligence community can monitor telephone and internet communications outside the United States pretty much at will. So if Roger Stone is taking a break from his swinger club activities (I know, ewwwww!) to chat with foreign rat-fuckers, then he did it bareback, and exposed himself in an area where he doesn't have any constitutional protections.
