8. He can't do that

Unless the nominee was already either -
1.) previously confirmed by the Senate in some other capacity or is
2.) currently a civil servant in the federal government
then a President can't unilaterally "appoint" someone into such a position requiring Senate confirmation whether as "acting" or not.
David Uhlmann is currently a professor at University of Michigan's Law school.
