In the military that's an EEOC violation and has been since the late 80s when I joined
So, chances are you have one of three things; 1. he violated EEOC and was verbally reprimanded -- which means he definitely knows better; 2. nothing was said because he was the highest ranking person in the room at the time -- which means he was still in violation; 3. he's lying.
