Court orders DeLay subpoenas halted Mar. 14, 2006

U.S. Rep. Tom DeLay, R-Texas, won a legal skirmish when a court invalidated 30 prosecution subpoenas and ordered that no more be issued, reports said.
A Texas State Court of Appeals ruled Monday that all prosecution subpoenas must wait until it rules on an appeal brought by the state.The appeal, on which oral arguments will be held March 22, contests a judge's dismissal of conspiracy charges against the former U.S. House majority leader involving Texas' 2002 legislative elections.

"All of those subpoenas are worthless," DeLay's lawyer, Dick DeGuerin, told the Austin (Texas) American-Statesman. DeGuerin said he would make sure all who were subpoenaed get the ruling "so they can thumb their nose" at Travis County, Texas, District Attorney Ronnie Earle.

"The point here is Ronnie Earle is abusing his office," another DeLay attorney, Matt Hennessy, told the Houston Chronicle. An Earle spokesman said prosecutors, who were trying to get ready for DeLay's eventual trial, would abide by the ruling.
