It is very possible that AOL still has logs from this on their servers and if so, it has probably already been verified by AOL.

Excellent point.

The assertion of the OP is something only a desperate, back-to-the-wall defense attorney would use and even then, probably not use at all if there is a possiblity the logs were sitting on a server.

In addition, there is the question of how much good questioning the logs would do when there is other corroborating evidence. The point of the OP is "out there" when these factors are considered.
