The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

And I thought, this is how Torquemada Gonzalez is screwing us. He's parsing the Constitution and operating on the basis that any power not spelled out as accruing to the Executive, does. And any right not spelled out as accruing to the People, doesn't.
