Alito's vagueries in the hearings were entirely transparent. Neither he nor the senators who will soon vote on his confirmation harbor any illusions about what his agenda is, or what he will try to do while on the SCOTUS. Roberts was a different story; there remained questions as to whether he was an ideology-driven freak or a careless corporatist, and now we know: he's a fitting replacement for Rehnquist. With Alito, there is absolutely ZERO doubt where he stands: somewhere to the right of Scalia.

As such, the senators can readily make up their minds, taking into account their constituencies, their own ideals, and the vector sum of judicial change they envision for the nation over the next 40 years. Alito is a known quantity.
