Time was when under law that was EXACTLY what would happen. In point of fact, if they are criminals, then torture and years of confinement without charges and legal representation would insist on this, or if "enemy combatants" then Geneva conventions apply as they would more properly be called prisoners of war. Enemy combatants has no legitimacy, nor torture any sanction under any US or international law. The Bush construct of a third category that named them as neither fish nor fowl is bullshit-even Adolph Eichmann on trial in Israel was not tortured. I have no idea how this will be resolved but I see no outcome that will not be a stain on my country's honor...
