Oceanside police defend shooting probe

A woman and her son were shot in an incident involving an off-duty San Diego police officer.

OCEANSIDE, CALIF. -- The Oceanside Police Department on Thursday defended its investigation into an incident in which an off-duty San Diego police officer shot a woman and her 8-year-old son after a traffic altercation.

Oceanside Police Capt. Tom Aguigui said investigators are still trying to figure out what led Officer Frank White to fire five shots at Oceanside resident Rachel Silva's car in a mall parking lot.

White was not arrested or tested for drugs or alcohol. But he was questioned after the shooting, which occurred about 9:15 p.m. on March 15.

A supervisor from the San Diego Police Department, a lawyer provided by the Police Officers Assn. and a "peer support" representative from the department were with White during the questioning.

White has been put on paid administrative leave.

White's wife, a Carlsbad police dispatcher, was with him in the car when the shooting occurred, and has been interviewed by police.

Silva, 27, has refused to be interviewed by police.

After she was treated at a hospital for her wounds, police required her to take a blood test. The results have not been released.

Silva was driving on a suspended license and had two drunk-driving convictions, according to court records. Aguigui said police had probable cause to order Silva's blood drawn, but none to make a similar decision involving White. He said San Diego Police Chief William Lansdowne was briefed about the incident as a courtesy to a fellow police department, but no similar briefing has been given to Silva's attorneys.

On the night of March 15, both White and Silva called 911 for help.

Aguigui would not describe the traffic incident or say whether White believed that his life was in danger.

Silva was struck twice in the arm; her son, Johnny, was struck once in the leg. Silva's ex-husband, a Marine serving in Iraq, has been given emergency leave to be with his son.

Aguigui said four bullet holes were found in the windshield of Silva's car and one in the front passenger's window. The driver's window of White's vehicle was shattered.

But Aguigui declined to describe the relative location of the two cars when the shooting occurred.

He said he could not estimate when the case would be taken to the district attorney for a decision on what, if any, charges would be filed.

Silva, who is being represented by civil rights attorney Eugene Iredale, filed a claim Wednesday with the city of San Diego for unspecified damages. The claim alleges that White, 28, who has been an officer for two years, is "manifestly unsuited" for his job and that Oceanside police are showing favoritism toward a fellow officer.

The claim also asserts that the San Diego department has been negligent in not testing its officers periodically to discover "rage tendencies."

"It seems to me the temperament shown -- the rage -- is the kind we do not want in a police officer allowed to carry a firearm," Iredale said.

Lansdowne, in a telephone interview, said that all officer candidates are given a thorough psychological screening before being hired.

He said that the department has psychological services available for officers and that they can either ask for help or be referred by their supervisors.

"We have a very good system," he said.

If her claim is rejected, Silva will be able to file a lawsuit.

At the sometimes combative Oceanside news conference Thursday, Aguigui denied suggestions of favoritism toward White.

"We are doing our best to do a very fair and complete investigation," he said.

The boy and his mother were in their car when the off duty police officer cut her off in traffic - Words were exchanged and I imagine hand signals and finger gestures. The unarmed woman was shot twice, her son shot once.... They had to be life flighted to hospitals...

I do not give a rats ass if she is an off duty hooker who deals marijuana on the side to pay her skyrocketing water bill... WTF reason does an armed officer have to unload his service revolver into a citizens car? She and her son are fortunate to be alive. This is why I do not engage drivers in any sort of give and take dialog which uses hand signals.

Fuck the police who are trying to justify this idiots behavior. He should be locked up and the city should cough up a massive amount of cash to pay the woman and her son in punitive damages.

This is some straight up BS. Every day I read shit like this my hatred of law enforcement officers grows. Sure, they're not all bad, but WAY too many of them are. This country is becoming a police state.

OCEANSIDE – At a news conference Thursday, Oceanside police released few new details about the shooting of 27-year-old Rachel Silva and her 8-year-old son by an off-duty San Diego police officer.

But one could be significant.

The driver's door window of San Diego Police Officer Frank White's Mercury sedan was shattered, Capt. Tom Aquigui said, reading from a statement. Aguigui declined to say how investigators think that happened.

In an interview Tuesday, however, Aguigui said police believe White fired at Silva's Honda from inside his car.

At the news conference, Aguigui also said there were five bullet holes in Silva's vehicle: four in the windshield and one in the window of the right front passenger's side door.

Police also said they recovered a handgun belonging to White at the scene. Aguigui declined to say whether or not the weapon was White's service firearm. Aguigui also said police have interviewed eyewitnesses to the shooting, but he would not reveal what they reported. He said police are interested in talking to anyone else who was there.

Oceanside police have said White fired five shots at Rachel Silva's Honda at the culmination of an apparent road-rage incident, one into the passenger's window and four into the windshield, but have released few other details.

In the latest claim, Iredale says White, 28, cut off Rachel Silva's car in traffic, and she drove into the Lowe's parking lot, where she and White “exchanged angry words.” Iredale said Tuesday the cars were side-by-side when the shooting began, the first shot hitting the boy in the knee when White fired from inside his car.

As Silva drove in reverse, away from White, the claim says, he fired four more rounds into the car. Iredale declined to specify if White was in or out of his car when those rounds were fired.

White identified himself as a police officer at some point during the encounter, Iredale said, but didn't display a badge.

The account, he said, was based on various sources, including interviews with Silva and her son and witnesses to the incident. The claim also says that while Rachel Silva was tested for drugs and alcohol, White was not tested, and that the boy was interviewed by police in a hospital room over the objections of his uncle. White, the claim says, was given “peer counseling” by a San Diego police official and never placed in custody.

15. This is the story
First, in this one case I say FUCK the police. The woman was obviously on the drivers side - the police officer was on the passenger side with a child between the drivers - The boy ducked and his legs went up in the air and he was hit in the knee. The police officer kept firing hitting the mother twice. He ordered her to turn off her car but she could not move her right arm.

The man went postal because he was challenged while driving - He had a gun and a mental problem.

There is no justification to have a case of road rage where people are shot.

The Oceanside police are doing what they can to smear the woman - they are doing what they can to make her look as guilty as possible.

Like I said - she was not armed nor was her 8 year old.

What could you say to justify a police shooting in this case?

This happens FREQUENTLY in San Diego. We have a problem here with unjustified police shootings.

I am not the type of person who hates the police or law inforcement - I just call 'em like I see 'em.

Any time a service weapon is fired, on duty or not, that officer should be required to give a piss, hair, and blood test so we, as the general public, can be sure that THEY are not under the influence...


Hey, they wanna enforce the law? sweet... Let em also be subject to it.

When congress was out wasting time on MLB roids not once did anyone mention piss testing public servants (cops, military, etc.)so things like this don't happen.

27. My dad was a cop, and I worked for the probation department for several years.
Cops and criminals are the same personality types-- adrenaline-charged bullies. They're playing the same game, like the red and black pieces in a game of checkers.

I hope the woman involved gets a million bucks.

He's going to be affected for life - there go his chances of being on the football team or the track team. If he just unloaded into the car because of his rage issues, which certainly sounds like the case, and continued firing even after she tried to escape, then they should be seizing each and every one of his assets to pay his share of the award. I hope he enjoys being homeless and carless to pay her.

Shooting through the windshield means he was aiming for the face.
