Father of boy who was shot files claim against San Diego -

Oceanside police have said White fired five shots at Rachel Silva's Honda at the culmination of an apparent road-rage incident, one into the passenger's window and four into the windshield, but have released few other details.

In the latest claim, Iredale says White, 28, cut off Rachel Silva's car in traffic, and she drove into the Lowe's parking lot, where she and White “exchanged angry words.” Iredale said Tuesday the cars were side-by-side when the shooting began, the first shot hitting the boy in the knee when White fired from inside his car.

As Silva drove in reverse, away from White, the claim says, he fired four more rounds into the car. Iredale declined to specify if White was in or out of his car when those rounds were fired.

White identified himself as a police officer at some point during the encounter, Iredale said, but didn't display a badge.

The account, he said, was based on various sources, including interviews with Silva and her son and witnesses to the incident. The claim also says that while Rachel Silva was tested for drugs and alcohol, White was not tested, and that the boy was interviewed by police in a hospital room over the objections of his uncle. White, the claim says, was given “peer counseling” by a San Diego police official and never placed in custody.
