If someone, say, Jon Stewart decided to re-enact a TSA search on TV, |
|
his network would no doubt be hit with a hefty fine by the FCC.
Think about that.

1. Nice try, but probably not. |

Furst, Stewart's show is on during the late night "safe harbor" hours and thus wouldn't have come under the FCC's rules. Second, even if the show ran during non safe harbor hours, it wouldn't violate the rules today, since the rules are not in effect, having been vacated by the US Court of Appeals. And finally, even under those rules as they existed before the court vacated them, and even outside of the safe harbor, its highly unlikely that a re-enactment of a search would have been deemed a violation of the FCC's rules.

2. So on-air groping is OK, but the infamous "wardrobe malfunction" is not? |
|
Also, The Daily Show is rerun several times each day, including morning and midday.

6. again, Jimmy Kimmel is on late night. And the rules are vacated |
|
and when they were in effect, they applied to the Jackson wardrobe malfunction because it involved nudity. Groping and copping feels and fondling have all occurred on broadcast soap operas and primetime shows and movies without fines.

7. Isn't Stewart on cable and thus not subject to FCC jurisdiction? |
|
At least that's what I thought. I've never seen the show, what network is he on?
