Furst, Stewart's show is on during the late night "safe harbor" hours and thus wouldn't have come under the FCC's rules. Second,even if the show ran during non safe harbor hours, it wouldn't violate the rules today, since the rules are not in effect, having been vacated by the US Court of Appeals. And finally,even under those rules as they existed before the court vacated them, and even outside of the safe harbor, its highly unlikely that a re-enactment of a search would have been deemed a violation of the FCC's rules.
