II C: The government may impose reasonable restrictions on the time, place, or manner of protectedspeech, provided the restrictions are justified without reference to the content of the regulatedspeech, that they are narrowly tailored to serve a significant governmental interest, and that theyleave open ample alternative channels for communication of the information.

(THAT'S NOT IN =MY= DAMN BILL OF RIGHTS!)


III A: 2.The Incident Commander shall be responsible for the development of a written operationsplan

(So someone somewhere is responsible, in writing, for ORDERING the presence and use of rubber bullets and flashbangs. Both of which the city denied using in a public statement.)


5 B.Deployment

1. Decisions about crowd dispersal and general strategies about crowd containment or crowdredirection, multiple simultaneous arrests, planned individual arrests, or planned use of forceshall be made at the level of the Incident Commander or higher.
a)If such decisions are made by higher ranking off-site OPD officials, it is required thatthe Incident Commander first be consulted about the state of affairs in the field and thepotential consequences of the decision.
b)All such decisions shall be documented in writing with regard to time, the identity of theperson making the decision, and the precise decision and directions given.

(So, someone somewhere is responsible IN WRITING.)

3.Each officer shall wear a badge, nameplate, or other device on the outside of his or her uni-form or on his or her helmet which bears the identification number or the name of the offi-cer, as required by Penal Code 830.10.The number or name shall be clearly visible at all times. The letters or numerals on helmets, jackets, and vests shall be clearly legible at a distance sufficient to provide a measure of safety for both officers and demonstrators/observers and, in no case, shall be less than twoinches in height on helmets.

(Notice the black tape across the left...Someone made a DECISION on this...in writing!)




5 C

4.Crowd control and crowd dispersal, as well as a show of force in crowd control situations,should be accomplished whenever possible using specialized units of OPD rather than on-duty patrol officers.

(So they have a specific group of thugs called upon to be violent. And they were requested in writing three times.)

5. This directive does not mean demonstrations must be allowed to deliberately disrupt com-muter traffic and/or bridge approaches.

(No, I'm sorry, civil disobedience and the BILL OF RIGHTS are the law, the PEOPLE'S LAW. Especially in response to your abuse of the people: infiltration, aiming at peaceful protesters, abrogation of the Bill of Rights, illegally covering your nametags)

This understanding does not mean OPD cannot take enforcement action against the crowd aspermitted under this policy, but OPD shall seek to minimize the risk that force and arrestsmay be directed at innocent persons

Oh, there's much more but it's probably as much BULLSHIT as is this.

1. The rank thuggery is staggering
In multiple instances - Oakland, New York, Boston, Denver, etc. - we 99% have watched vicious unprovoked assaults on Americans peacefully exercising our fundamental rights to free speech and free assembly. Thanks to YouTube and the ubiquity of cell-phone cameras we now know exactly what we're facing: goons and thugs doing the bidding of the 1%, and mooning our laws in the process.

The battle is at hand and sides must be chosen; I hope and believe that the vast bulk of America's police and military are good people who want to uphold the law of our land, and will choose to side with their own, the 99%.

This won't be easy, but we will win.

No, it's not, no more than it's listed that freedom of religion doesn't include human sacrifice, and the right to keep and bear arms doesn't include sarin gas or armor-piercing handgun ammunition. Doesn't mean those restrictions aren't constitutional the same as, say, a requirement for permits or other restrictions on demonstrations. This is simply a really poor point of argument.

6. Time place and manner restrictions are constitutional per the USSC.
That is what the poster was trying to tell you and your complaint about that exact phrasing not being in your Bill of Rights makes you sound uneducated and ignorant about the law when you make such a ridiculous claim. Here is a link:

4. They make up the rules as they go
I've noticed that no matter what the OWS do the next day or so there's a rule against it.

And it's definitely a police state tactic. I have no more doubts about whether we live in a police state anymore. It's just a matter of time before they really pull of the benign masks and start really bashing our heads in and arresting people and making them disappear.
