Greg Abbott: Bad Governor, Bad Lawyer

Barbara is a great lawyer who is very active in the Harris County Democratic Lawyers Association. Barbara has run for US Senate and Texas Attorney General back when Texas was truly a red state. It takes a ton of courage to put your name on the ballot in such a circumstance. Barbara is also a former college debater and was on the same debate squad as Mayor Sylvester Turner and one of the local bankruptcy judges who handles some of the tougher cases.

Greg is indeed a bad lawyer and a bad governor.

All law schools train aspiring trial lawyers and judges to gather evidence, evaluate witnesses, and test claims and theories. We also learn not to interfere in criminal investigations. But Texas Governor Greg Abbott seems to have forgotten his legal training—and his ethics given his recent ham-handed response to the horrific school shooting in Uvalde. Instead, his words and actions highlighted what appears to be a serious mental decline.

Among his first public remarks, Abbott claimed “it could have been worse” and praised “valiant public officials” for their “quick response.” He apparently relied on partial and misleading information he personally collected from officials in interviews—without bothering to review data such as 911 calls and apparently ignored parents at the scene. The governor has publicly described his process: “I wrote hand notes in sequential order. When I came out on that stage and told the public what happened, it was a recitation of what everyone told me.”....

Back in 2010, as the Democratic nominee for Texas Attorney General, I observed and personally engaged with Abbott, then the incumbent attorney general and my opponent. Back then, Abbott had already worked for a powerful law firm, became a district court judge, then a Supreme Court Justice. He seemed competent and could speak without notes. He seemed to have retained normal critical thinking and presentation skills as we sat answering pointed editorial board questions......

The governor now accuses the personnel he praised of providing inaccurate information—lies that, if they had been made to federal agents who are now investigating, could have been considered perjury. His notes and possible testimony about statements made by officials may be important to current investigations and prosecutions. They’re relevant both to ongoing criminal investigations and related legislative, executive, and judicial branch efforts throughout all levels of local, state, and federal governments and agencies who will continue to address issues related to this deadly school shooting for many years to come....

Unfortunately, Abbott appears unfit for the hard job ahead, which will require him to deal with reality, including the effects of public policies he turned into laws allowing an 18-year-old to buy the gun used for the massacre.

Judge Moss tells the lawyer-less Peter Navarro that (in a nutshell) his lawsuit makes no sense

A person who represents himself has a fool for a client. The petition filed by Navarro was so bad that it was funny. The judge read the petition and told Navarro that his petition is a piece of garbage and to refile something that makes sense. This two page ruling makes me smile

Fetterman's health, return to campaign trail a mystery as some Democrats grow 'very nervous'

Pennsylvania Democratic Senate nominee John Fetterman does not have a timetable for returning to the campaign trail, sparking some worries in the party nearly three weeks after he suffered a stroke and surgeons implanted a pacemaker with a defibrillator to regulate his heartbeat.

Fetterman, the state’s lieutenant governor, has appeared publicly only in recorded video since the stroke. His wife is speaking to the media on his behalf. And the situation has prompted Democrats to refresh their knowledge of state ballot-replacement law — the deadline is in August — according to two party sources who said they don’t anticipate a candidate switch being necessary......

There has been “no indication” of a timeline for Fetterman’s return to the trail, said an elected Pennsylvania Democrat who has interacted with Fetterman. “A lot of us Democratic Party types are very nervous about it.” The official, who asked not to be named to avoid blowback from his party, said Fetterman needs to be transparent both because it’s the right thing to do and good politics.....

The careful statements from Fetterman’s campaign since his stroke and surgery have done little to answer lingering questions about his health or whether he has fully disclosed the scope of his heart condition. Several cardiologists told The Philadelphia Inquirer last week that defibrillators are not used to treat atrial fibrillation, the irregular heart rhythm that the campaign has said led to Fetterman’s stroke. In an interview with Politico, Gisele Fetterman said doctors found no new heart issues during a Wednesday follow-up with the physicians who treated his stroke.

Pennsylvania Democratic Senate nominee John Fetterman’s wife, Gisele, said in a new interview that doctors are “very happy with how he is healing” from his stroke.

“The neurologists, they were really impressed with the progress. Cognitively, he’s perfect and well on his way to a full recovery,” Gisele Fetterman told Politico. “Everything went well with the cardiologists. His heart is looking good. Pacemaker is working as it’s supposed to.”

She added, however, that the doctors at Penn Medicine Lancaster General Hospital “want him to continue to rest.”

Gisele Fetterman told the news outlet that doctors are not yet sure when it will be safe for her husband to return to the campaign trail, noting that “the campaign will have an announcement for that soon.”

Hidalgo aide says Ogg is biased, should be removed from vaccine contract case

Harris County Judge Lina Hidalgo is an amazing lady. In Texas, the County Judge is not a judicial office but is the chief executive officer of the County. I remember meeting Lina Hidalgo at a Harris County Democratic Lawyers Association meeting in 2018 and was very impressed with her but I was worried about her age. Lina Hidalgo was running against Ed Emmitt who was an old-line republican who most thought did a good job during the Hurricane Harvey mess. Lina beat Emmitt and has been doing a great job including adopting county wide election day voting and dealing with the COVID mess. In 2020, voter turnout in Harris County increased due to drive through voting, 24-hour voting and other innovations that the GOP has now outlawed because they work.

It is commonly believed that Lina is a rock star in Texas politics and will be headed to higher office which has old line types such as Harris County DA Kim Ogg worried. Kim Ogg has been a disappointment to many hard-core Democrats and it is clear that Kim Ogg is jealous of Lina Hidalgo.

Kim Ogg has indicted three aides to Lina including the son of a lawyer who I used to practice law with back when I was at the same firm as Greg Abbott. This matter is getting nasty and I support Alex Triantaphyllis who is a good lawyer despite having a patent attorney for his dad.

Harris County Judge Lina Hidalgo's chief of staff Alex Triantaphyllis, one of three aides facing charges related to a controversial COVID-19 contract, filed a motion Wednesday afternoon asking a district court judge to remove Harris County District Attorney Kim Ogg from the case, arguing the prosecutor has a conflict of interest and should be replaced with an "unbiased attorney."

In the 36-page motion filed Wednesday, Triantaphyllis argued Ogg has engaged in a "months-long, highly public feud" with Hidalgo while demanding budget increases for her office, thereby failing to avoid the appearance or reality of a conflict of interest and warranting Ogg's disqualification and replacement with an "unbiased attorney" in her place.

Harris County District Attorney spokesperson John Donnelly said the office was reviewing the motion and had no immediate comment.

The next court date is set for June 16, Donnelly said.

Hidalgo and Ogg have exchanged heated words in recent weeks over the indictments. Hidalgo, who is up for reelection this November, argued Ogg's investigation is meant to derail her campaign.

The hard core democrats I know are backing Lina and are all upset with KIm Ogg including due to the fact that Kim Ogg has been briefing republicans like Ed Emmitt.

This will be an interesting fight to watch
