LA sheriff clashes with county lawyer over closing gun shops

The Los Angeles County sheriff reversed his own decision Tuesday to order deputies to make sure gun shops were closed during the coronavirus crisis after the county's top lawyer said the shops could be open.

Los Angeles, the nation’s largest county with 10 million residents, enacted a stay-at-home order last week that required all nonessential businesses to close to slow the spread of the virus.

Sheriff Alex Villanueva had said gun stores were not essential businesses and they had been selling to the public through a “loophole” allowing them to stay open, many attracting long lines of customers.

But the county order — and an executive order from Gov. Gavin Newsom — does not specifically mention gun shops, prompting the Los Angeles County counsel's office to issue a statement hours later on Tuesday saying it has “opined that gun stores qualify as essential businesses.”

A few issues:
-first, the Constitutional one, can all locations that directly relates to an enumerated right be ordered closed as non-essential? If such an order applies to gun sales woul it not also then potentially be possible to be applied to other rights i.e. order all churches and/ or media closed as "non-essential"?

-regardless of what the business is, why is it being left to law enforcement to decide what is or is not an essential business?
-if the county attorney has declared a business is essential, how is the sheriff free to ignore that and order a business closed anyway?

If schools close for the upper CDC recommended time

of 20 weeks, will children all just repeat the grade they are currently in?

There are approximately 10 weeks remaining in the school year. Closing for 20 weeks now would take us to the end of July. That would only leave August to make up the missed time. Also teachers would have no time to prepare for the next school year.

It could be possible to do a combined year for many grades and complete the current year curriculum and seguing into the next, but what about those who are graduating? How can a high school senior do 2-3 months worth of work to complete their graduation requirement in a single month then immediately go into college?

Guns and waiting periods

There have been many proposals for waiting periods longer the 3 days, up 6 months or a year on the high end.

Lately there have been a few posts around DU of people who never before have considered owning a gun questioning if they may have to buy one in the near future. Should those people decide to purchase a gun, based on real or perceived threat, they may find that will not be able to take the gun home until the waiting period has elapsed.

Considering that there may be a more immediate need during critical times, would those who support long waiting periods (let's arbitrarily define long as greater than 7 days) believe the waiting period be reduced or waived during specific crisis time e.g a natural disaster or declared national emergencies?

Peacetime state of emergency' declared in Minnesota amid COVID-19 concerns

In light of novel coronavirus (COVID-19) concerns, Minnesota is entering into a peacetime state of emergency.

Gov. Tim Walz made the announcement about the state of emergency, which will last for five days, on Friday.

State leaders will have the option to extend the state of emergency for another 30 days. After 35 days, the legislature would be required to approve another extension.

Walz announced the creation of several legislative proposals, including a COVID-19 emergency fund. That fund would expand access to testing and paid leave for employees who must stay at home.

Husband of LA County DA pulls gun on Black Lives Matter protesters

The Los Angeles County District Attorney’s husband pulled a gun and threatened to shoot protesters who gathered at their home in Los Angeles, California, on Monday, March 2, according to local media.

About 30 protesters went to District Attorney Jackie Lacey’s home in Los Angeles’s Granada Hills neighborhood “to protest her refusal to meet with black activists and organizers,” the Los Angeles Times reported. A Black Lives Matter organizer told the LA Times the group of activists decided to have the meeting “in front of her house” in response.

Lacey said in a statement that she and her husband, David, awoke to noises outside their home on Monday morning, prompting them to call the police. She then confirmed that her husband drew his gun and asked the protesters to leave. Lacey said it was not the first time she has been confronted.

“As district attorney of LA County, I’ve received threats — some of them death threats. I have been followed, photographed while with my family, confronted at an art museum, confronted at fundraisers,” Lacey said in the statement.

On the one hand, the protesters should not be on the porch and by refusing to leave were trespassing.

On the other hand I do not believe California has castle doctrine. Also it would be hard to claim self defense since he had to open the door to confront the protesters.

It will be interesting to see if the DA has to charge her husband for brandishing or if "sorry" is good enough.
