(172,264 posts)We are now 10 days out from the end of the calendar year and 12 days out from the technical end of this "116th Congress" session (the sessions being 2 years long). On January 3rd, 2021, the 117th Congress will be sworn in and any legislation not taken care of before then, becomes moot.
If he sits on it and doesn't sign it at this point in the year, then it dies. Any other time, after 10 days of not signing legislation will mean it will automatically become law (without his signature). But because they are ending a 2-year session, and if he doesn't actively veto it, then then it becomes a pocket veto, and that kills it outright.
I thought of one thing that might salvage it if they were up to it, and that would be to have some 2nd separate bill that perhaps adds additional money to the current package - perhaps something that would be doled out later in 1st or 2nd quarter. It could be done by unanimous consent by both chambers but there are loons who would have a fit and would demand a debate and probable roll call vote, plus there are the complaints about the "other stuff" that is in the current legislation and that would have to be ignored by 45 if an additional $1400 could be made into a "Squirrel!!" moment to get him to sign both.
The problem too is that without a signature, we would now be in a government shutdown because that legislation included appropriations for FY21 and the 1-day C.R. extension probably expired at midnight, with the "wink wink" that yes the appropriations will be signed today.
