(165,644 posts)44. Well early on, Obama lost a SCOTUS case regarding the meaning of a "Pro-forma" session
so if anything, he was able to get it codified that the SCOTUS allows Congress to "make its own rules". However I'm not sure how that might be interpreted for the pocket veto (which is actually noted in the Constitution as an automatic "veto" under specific circumstances).
I think previous Congresses actually adjourned when a pocket veto occured. I also think I read the last pocket veto during a lame duck session was one done by Bill Clinton (other ones were done during the year when Congress was "adjourning" for a long break, etc.).
