Lawrence Tribe on how fucked Kegsbreath is...

Department of Defense Law of War Manual, Sec. 18.3.2.1 states the "requirement" to refuse illegal orders.

What’s its key example? Wait for it . . . It’s "orders to fire upon the shipwrecked."

BREAKING: Leaked calls prove Russia authored the peace deal

‘Just Staggering’: Trump Aide’s Leaked Phone Call With Putin Advisor Stuns Pundits

https://www.mediaite.com/politics/just-staggering-trump-aides-leaked-phone-call-with-putin-advisor-stuns-pundits/

Bloomberg News stunned the political world on Tuesday by releasing the leaked transcript of a call between Trump’s special envoy Steve Witkoff and Russian foreign-policy adviser Yuri Ushakov, which took place on Oct. 14.

The transcript shows Witkoff coaching his Russian counterpart on how to flatter President Donald Trump in order for him to be more amenable to Russia’s wants in the negotiations to end the war in Ukraine.

The transcript also included Witkoff telling the Russians, “ I know what it’s going to take to get a peace deal done: Donetsk and maybe a land swap somewhere. But I’m saying instead of talking like that, let’s talk more hopefully because I think we’re going to get to a deal here. And I think Yuri, the president will give me a lot of space and discretion to get to the deal.”

Bloomberg also published an October 29 “phone call between Yuri Ushakov, Vladimir Putin’s most senior foreign-policy adviser, and Kirill Dmitriev, an economic adviser to the Russian president.”

During that call, Dmitriev appeared to suggest that the draft of the recent peace plan came from Russia. “ No, look. I think we’ll just make this paper from our position, and I’ll informally pass it along, making it clear that it’s all informal. And let them do like their own. But, I don’t think they’ll take exactly our version, but at least it’ll be as close to it as possible,” Dmitriev. The Trump-backed proposal was quickly derided as offering too many concessions to Russia, including by many GOP members of Congress.

The next Democratic POTUS

Better not ignore the past and “move forward”.

We need justice.

We need to prevent anything like a Trump again. There are far smarter and more evil versions of him quietly watching and waiting from the shadows. We need to send them all a message: that fucking with the People’s Democracy comes with the ultimate price.

Otherwise we are doomed to more greater suffering. No Garlands. We need prosecutorial bull dogs. Follow the law, but don’t give into the bullshit platitudes that allowed Trump’s second Presidency.

We also need to send a message to MAGA. Education matters. Individual freedoms matter. Make it impossible to discriminate. Pardon all illegal immigrants with no violent criminal records and give them immediate citizenship. Reaffirm this country’s status as a melting pot nation of immigrants.

And finally, but most importantly, make the rich pay while taking away their power. Codify the reversal of Citizens United and tax the ever loving fuck out of the 1%.

We may get only one more chance to do this, and that’s only if we continue to resist with tenacity.

Breaking: Putin authored Trump's Ukraine "deal"

https://newrepublic.com/post/203517/trump-ukraine-peace-deal-russian-language

Trump’s Ukraine Peace Deal Appears to Be Translated From Russian

Certain phrases in Trump’s proposed deal seem to be using Russian language.

The U.S. peace plan presented to Ukraine appears to have been translated from Russian.

The syntax of certain phrases are more common in the Russian language, such as the third point of the 28-point plan: “It is expected that Russia will not invade neighbouring countries and Nato will not expand further.”

“It is expected” is not commonly used in English, but it is common in Russian and appears to come from the phrase ожидается or ozhidayetsya, according to The Guardian’s Luke Harding. Other words that appear to be translated from Russian include “ambiguities” (неоднозначности and “to enshrine” (закрепить .

Holy Shit! Halligan spliced transcripts to court claiming Grand Jury did see both indictments!

This judge is about to go nuclear when they read this response:

Reddit Law Subreddit discussion: https://www.reddit.com/r/law/s/CofesKS6XW

Response filed by Halligan: https://storage.courtlistener.com/recap/gov.uscourts.vaed.582136/gov.uscourts.vaed.582136.206.0.pdf

Link to explanation: https://www.reddit.com/r/law/s/YJpoEvNNoV

Look at Section Il in the filing, for example:
"Il. The Court Acknowledged the Clerical Discrepancy and Directed That the Two-Count True Bill Be Docketed"
Below it, sentence fragment --> transcript image --> paragraph --> image.
The first transcript image shows that the magistrate identifies the two conflicting documents, "I'm a little confused as to why I was handed two things with the same case number that are inconsistent." (Magistrate's quote)
Discrepancy -- check; court confirmed.
Now, let's go back to the Sect. Il title: "Direct That the Two-Count True Bill Be Docketed"
That's not exactly what happened though...
"I assume you intended to make it public, so these both will go on the docket in -272 now that it's been presented in open court. I just want to make sure that you understand that and that was your intention."

That, on one hand, is a magistrate judge obviously declaring what will or won't be on the record, but the key point (for me -- I'm sure someone else will vociferously disagree) is that when the judge is clarifying or trying to elucidate intent, they're not actually in direction or control of the substantive matter, rather they're procedurally ensuring that the jury's will be enacted.
The jury, it seems, never actually saw the indictment that Halligan was pushing forth, because only the foreperson and juror (from the reporting elsewhere) signed it, not all 12.
That's just example, but when you piece it together with, "any assertion that the grand jury
"never voted on the two-count indictment" is contradicted by the official transcriptLI" it doesn't pass the smell test on whiff.
Even their conclusion doesn't hit the real problem: the federal grand jury NEVER SAW THE INDICTMENT THAT THE FEDERAL PROSECUTOR PURSUED.

Dear Democratic Leadership: DON'T CAVE

Get those ACA subsidies back. Americans showed you this week that we stand with you and applaud your stand. Now is the real fight. Stand tall, you win. Cave and lose everything.
